Leading Harvard philosophy professor William Ernest Hocking (1873-1966), author of 17 books and in his day second only to John Dewey in the breadth of his thinking, is now largely forgotten, and his once-influential writings are out of print. This volume, which combines a rich selection of Hocking’s work with incisive essays by distinguished scholars, seeks to recover Hocking’s valuable contributions to philosophical thought.

The rapid implementation and continuing expansion of forensic DNA databases around the world has been supported by claims about their effectiveness in criminal investigations and challenged by assertions of the resulting intrusiveness into individual privacy. These two competing perspectives provide the basis for ongoing considerations about the categories of persons who should be subject to non-consensual DNA sampling and profile retention as well as the uses to which such profiles should be put. This paper uses the example of the current (...) arrangements for forensic DNA databasing in England and Wales to discuss the ways in which the legislative and operational basis for police DNA databasing is reliant upon continuous deliberations over these and other matters by a range of key stakeholders. We also assess the effects of the recent innovative use of DNA databasing for “familial searching” in this jurisdiction in order to show how agreed understandings about the appropriate uses of DNA can become unsettled and reformulated even where their investigative effectiveness is uncontested. We conclude by making some observations about the future of what is recognized to be the largest forensic DNA database in the world. (shrink)

Current methods of forensic DNA profiling, based on Polymerase Chain Reaction amplifications of a varying number of Short Tandem Repeat loci found at different locations on the human genome, are regularly described as constituting the “gold standard for identification” in contemporary society. At a time when criminal justice systems in Europe and North America increasingly seek to utilize the epistemic authority of a variety of sciences in support of the apprehension and prosecution of suspects and offenders, genetic science and recombinant (...) DNA technology are often singled out for particular approbation. Most simply stated, the business of Metaphysics is to understand the world, that is to say, the given world which, as given, is one stupendous Fact. This is something more than describing the world. Description, accurate and adequate, is the business of science: understanding the world is making sense of it--a quite different matter. That there is such a task implies that the world does not wear its sense on its sleeve: it presents much that seems nonsense, much that seems (...) anti-sense or what some of our French comrades call absurdity. It is precisely this refusal to make sense that is embodied in the concept of Fact. (shrink)
